GiversHive Terms and Conditions

1. Introduction

Welcome to GiversHive, a mobile application and platform operating in Nigeria. These Terms and Conditions govern your access to and use of the GiversHive mobile application and website.

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all the terms and conditions of this agreement, then you may not access the Service.

2. Eligibility and User Accounts

2.1 Eligibility

The Service is intended for use by individuals who are at least 18 years old and legally capable of entering into binding contracts. By using the Service, you represent and warrant that you meet these requirements.

2.2 Account Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.3 Account Security

You are responsible for maintaining the confidentiality of your account password and are fully responsible for all activities that occur under your account. You agree to immediately notify GiversHive of any unauthorized use of your password or account or any other breach of security.

3. Services Provided

GiversHive is a platform that connects individuals who wish to donate (Givers) with verified organizations, causes, or individuals in need (Recipients) within Nigeria. The Service facilitates, but is not responsible for, the actual transfer of funds or items.

3.1 Financial Transactions

All financial transactions processed through the Service, including donations, are subject to the terms and conditions of the third-party payment processor(s) utilized by GiversHive. GiversHive is not a bank or a money transmitter. We assume no liability for the security or processing of your transactions.

3.2 Donation Commitment

By initiating a donation, the Giver acknowledges and agrees that the donation is made voluntarily and is generally non-refundable.

4. User Conduct and Responsibilities

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law, including laws governing financial transactions and anti-money laundering.
• Infringe upon the rights of others, including copyright, trademark, privacy, or publicity rights.
• Transmit any unsolicited or unauthorized advertising, promotional materials, or any other form of solicitation (spam).
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of GiversHive and its licensors.

6. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including, without limitation, a breach of the Terms.

7. Limitation of Liability

In no event shall GiversHive, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.

8. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located within Nigeria to resolve any legal matter arising from these Terms.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice before any new terms take effect. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
